DEFINITION OF TERMS
Affected All the people affected by the project through land acquisition,
persons (APs) / relocation, or loss of incomes and include any person, household,
households firms, or public or private institutions. APs/AHs therefore include: (i)
(AHs) persons affected directly by the safety corridor, right-of-way, tower or
pole foundations or construction work area; (ii) persons whose
agricultural land or other productive assets such as trees or crops
are affected; (iii) persons whose businesses are affected and who
might experience loss of income due to the project; (iv) persons who
may lose work or employment as a result of project impact; and (v)
people who lose access to community resources as a result of the
project.
Compensation Payment in cash or kind for an asset to be acquired or affected by a
project at replacement cost based on current market value.
Cut-off-date The date prior to which the occupation or use of the project area
makes residents or users of the same eligible to be categorized as
AP. The cut-off date will coincide with the census of AP and the
inventory of losses (IOL) that will be conducted by the national
agency implementing land acquisition. Persons not covered in the
census would not be eligible for compensation and other
entitlements unless they can provide evidence that (i) they have
been inadvertently left out during the census and the IOL; or (ii) they
have lawfully acquired the affected assets following completion of
the census and the IOL and prior to the conduct of the detailed
measurement survey (DMS).
Eminent The right of the state or the government using its sovereign power to
domain acquire land for public interest in accordance with appropriate
regulatory provisions.
Encroachers Those people who move into the project area after the cut-off date
and are therefore not eligible for compensation or other rehabilitation
measures provided by the project.
Entitlement The range of measures for compensation and other forms of
assistance provided to the APs in the respective eligibility criteria.
Income This is the re-establishment of sources of income and livelihood of
restoration the affected households.
Inventory of The process where all fixed assets and sources of income and
losses (IOL) livelihood inside the project right-of-way (ROW) are identified,
measured, their owners identified, their exact location pinpointed,
and their replacement costs calculated.
Land The process of acquiring all or part of the land and other assets
acquisition attached to the land owns or possesses, to the ownership and
possession of that agency, for public purposes, in return for fair
compensation. The land acquisition and resettlement plan is known
as LARP.
Meanigful A process that (i) begins early in the project preparation stage and is
carried out on ongoing basis throughout the project cycle; (ii)
